Extraordinary Committee of the Member of Parliament and the Senate, who is responsible for discussing and
\nexplaining to Parliament to consider the amendment of the Civil Procedure Code.<\/p>\n
Mr. Kiatkrerkkrai Jaisamut, on behalf of the Extraordinary Committee of the Member of Parliament and the
\nSenate, expressed the opinion to the Extraordinary Committee of the Member of Parliament and the Senate
\nabout the amendment of the Civil Procedure Code, Section 20 ter, into 2 issues which are;<\/p>\n
1. Issue relating the amendment of jurisdiction, Mr. Kiatkrerkkrai Jaisamut explained that the purpose is for
\nthe public who wish to enter the mediation process but do not know where the jurisdiction is. Therefore, it
\nshould be revised that the provision of the said section allow the public to file a petition at any court, then the
\ncourt that accepted the case submitted the matter to the court with jurisdiction.<\/p>\n
2. Issue relating the involvement of lawyers in the mediation process, Mr. Kiatkrerkkrai Jaisamut explained that
\nfor benefit of the people under basic rights according to the Constitutional Law, it should be revised that the
\nprovision of the said section, the mediator may or may not have lawyers, because lawyers are considered to
\nplay an important role in resolving disputes in the process of mediation, both before and after the lawsuit.<\/p>\n
Lastly, parliamentary meeting passed a resolution to approve the amendment of the Civil Procedure Code,
\nSection 20 ter, especially with the addition of the said provision that “The mediator may or may not have a
\nlawyer”. It can be considered as a complete benefit to the dispute resolution of the people.<\/p>\n<\/div>\n
